These General Conditions determine the terms and conditions that apply to the use of the Zigiz-website and the services and features offered on or via the website. By using the Zigiz-website, Player agrees to these General Conditions. At its sole discretion, Zigiz may amend these General Conditions, without prior notice of the Player. Continued use of the Zigiz-website will constitute Player's binding acceptance of any such amendments.
1. In General
| 1.1 | Zigiz reserves the right to refuse a Player's admittance and/or block a Players-account. |
| 1.2 | Zigiz is entitled, at its sole discretion, to discontinue or alter (any aspect of) the game at any time. |
| 1.3 | Although Zigiz takes great care in the administration of the Zigiz-website, Zigiz can not guarantee the correctness, accuracy and completeness of the information, services or features offered on or via this website. |
| 1.4 | If, in Zigiz's sole determination, a Player is found of any unlawful or wrongful conduct, Zigiz may take any far-reaching measures, in which Zigiz may block an IP-account or freeze the pay-out of any winnings. Such unlawful or wrongful conducts include, but are not limited to:
- (a) The use of the Zigiz-website and its services or features as a way to launder illegal obtained money;
- (b) The unauthorised usage of phone lines and the unauthorised usage of stolen or found mobile phones;
- (c) Defrauding credit companies.

| 1.5 | All Zigiz's decisions shall have binding effect upon the other party. |
2. Play for Fun or Play for Real
| 2.1 | Zigiz offers various online games, in which you can 'play for Fun' or 'play for Real'. Winnings can only be Realized in the 'play for Real' games. In order to participate in a 'play for Real game' a Player needs to buy game-credits. Only the profits made on these game-credits will be paid out to the Player. Zigiz recommends all Players to participate in the 'play for Real' games for an amount of not more than EUR 50 a day. |
| 2.2 | To upgrade your credit telephonically, number recognition must be enabled. Without number recognition, eventual incorrect upgrades cannot be corrected. |
| 2.3 | Upgrade credits with Paypal
Your transfers are only accepted if you meet the following conditions:
- (a) A confirmed PayPal-address has to be linked to transfers.
- (b) Only 1 PayPal-account is allowed per Zigiz account.
- (c) You have to use the same e-mail address for your Zigiz account and PayPal-account.
- (d) E-CHECKS are not accepted at this moment.
- (e) Check if your PayPal-account is connected to a country or state where participating in games of skill is legal.

| 2.4 | Refund policy.
If due to a technical failure of which the cause lies completely within the control of Zigiz, a game cannot be finished, Zigiz will credit your account with an amount up to the equivalent credits/costs that were charged to your account for playing the particular game. We do however not have any responsibility or liability to pay winnings which may potentially have been won if you could have finished the game without the occurrence of such technical failure.

| 2.5 | It is your responsibility to check whether national, federal, state or other laws and/or regulations to which you are subject allow you to participate in the ‘play for real’ games. In case such laws and/or regulations do not allow you to participate in the ‘play for real’ games, you will not participate therein. ´Play for real’ is currently not available for players from – among other countries – Italy and the United Kingdom.

| 2.6 | You fully understand that by participating in the ‘play for real’ games, you may lose money. You acknowledge and accept that only you are – fully – responsible for any such loss. |
3. Prizes
| 3.1 | Prizes will be paid out within eight (8) weeks after playing the game, on a valid bank account of the Player or any other account accepted by Zigiz. A bank account is considered to be valid when the registration data provided by the Player is accurate and true.

| 3.2 | Prizes will only be granted to winners. A winner may not transfer or dispose any of his winnings. |
| 3.3 | If a Player does not receive his winning(s), a notice of default must be made by e-mail within thirty (30) days. After this 30-day period all claims are waived and no reFunds of any kind shall be made. |
| 3.4 | All winnings represent the net value. Zigiz is entitled to report and withhold any amount from the winnings if such is required by law, and in any event, withhold taxes due in connection with any winnings awarded to the Player.

4. Competence
| 4.1 | In order to participate in a 'play for Real'-game offered on or via the Zigiz-website or to obtain any winnings, a Player must:
- (a) have submitted al required registration data in accordance with the truth;
- (b) have obtained a Zigiz-username in combination with a valid
e-mailaddress;
- (c) have obeyed the rules of the games; and
- (d) have reached to age of 16, or such age as may be required by law.

5. Players identity
| 5.1 | Zigiz may, in the event of any discrepancy, determine at its sole discretion who shall be entitled to the winnings. This will, ordinarily be the Player who is considered to be the valid and authorised owner of the IP-account. The valid and authorised owner of the IP-account is the person under which name the e-mailaddress is registered at the internet access provider, the service provider or any other online domain registration. |
6. Participation
| 6.1 | It is prohibited to make use of a system (including machines, computers, software or other automated systems) designed specifically to defeat or to manipulate the Zigiz system. |
| 6.2 | Any of such use will automatically result in a complete and permanent exclusion of the Player from the Zigiz-website. |
| 6.3 | Zigiz is entitled to take all measures necessary to prevent and detect any unlawful and fraudulent use of the Zigiz-website, or the services or features offered. |
7. Privacy
| 7.1 | The registration data of the Player is subject to the Zigiz . By use of the Zigiz-website or the services or features offered, Player agrees to the contents of this policy. |
8. Trademarks
| 8.1 | Zigiz-website, web documents, illustrations, logos, service marks, trade names and programmes used on the website, including all software, are the property of Zigiz. The trademarks may not be copied, downloaded or otherwise used without the permission of Zigiz. |
9. Indemnity
| 9.1 | In no event shall Zigiz be liable for any direct or indirect damages arising out of or in any way connected with the use of the Zigiz-website and the services and features offered on or via the website, including but not limited to any failure of performance, error, interruption, deletion, defect or computer virus. Neither can Zigiz be held responsible for any incorrectness, inaccuracy or incompleteness of the information, services or features offered on or via the Zigiz-website. |
